Unvelope.com Privacy Policy

1.    Membership and Free Trial Site Usage/Access Information

1.1   Full Membership

Membership allows you to browse, preview, personalize and send our e-cards for the term of your membership. To become a member, you will be required to provide us with your name, e-mail address, country of origin and current, up-to-date credit card information. You will need to create a login and password for your Member Account page. This is the information that will be used to identify you and enable your account. Unvelope.com will not divulge any of this information to any third party without your permission (Please refer to items 7 and 13 of this document for any exceptions.) Membership acknowledges acceptance of our Terms of Sale and Usage Agreement, Terms of Service Agreement and this Privacy Policy.

1.2    Free Trial Site Usage
On occasion, unvelope.com, also referred to as "unvelope," will offer limited free trial Site usage. Free Trial guests may browse and preview all of our site's ecards; however while members can personalize, schedule and send all site offerings, free trial guests can only personalize and send, for same day delivery,  e-cards listed as "Free" card offerings. You will be asked to set up a Limited Free Trial Guest account page consisting of your name, e-mail address and country of origin. Free Trial guests, like members, will need to create a login name and password for security purposes. Should you opt, at any time, to become a paid member, your limited free trial period login name and password will be retained and used as your paid member account information.

2.    Membership Tools and Card History
Membership with unvelope.com entitles you to an online account,  a personal address book, a personal monthly calendar, and a card history listing of scheduled and sent ecards. Unvelope.com will advise members via email  of the need to renew their membership. Members will intermittently be informed when new e-cards have been added to the collection.

3.     The following is a partial list of the emails that we may send you:

3.1.   Card Notifications
Unvelope.com will notify members in the event a scheduled ecard cannot be delivered to recipient(s). Please be advised that delivery failure may occur if you have input an incorrect email address, if the recipient has changed their email address, if you have not updated email addresses in your personal address book, and/or if the recipient's server blocks unvelope.com and other emails.

3.2.   Calendar Reminders
Once you are logged in, your Unvelope.com Personal Home Page Calendar will remind you of special occasions (i.e.: birthdays, anniversaries, special occasions, holidays, etc.) that you have entered into your Personal Address Book.

3.3   Membership Renewal Options and Reminders (Also see Terms of Sale and Usage Agreement)
Unvelope.com will not automatically renew memberships; however, we will send you timely reminder notices prior to your membership expiration date. At that time, you can opt to renew for a one (1) or two (2) year term. Unvelope.com will send you a renewal confirmation via email. As a further reminder, membership expiration dates are noted on your Personal Membership Account Page. 

Please note that for your protection unvelope.com does not store your credit card information. Therefore, when responding to renewal notices, you will be directed to your Membership Account page and you will need to input your current credit card information. 

3.4   Help
We will endeavor to promptly address your queries for help, lost password, correspondence and account information and other questions you may have.

3.5   Information
Information will be sent about new e-cards that have been added to our collection, cards that will be available in our archived area, links to other sites and or articles of interest for our membership based on their selection history.

4.    Cookies
Unvelope.com’s website uses a technology called “cookies.” A cookie is a small amount of data that is sent to your browser from a web server and stored on your computer’s hard drive. Cookies store member information as well as account preferences and account status. Cookies enable you to login successfully as well as authorize us to send your e-cards. Each browser is a little different. You may be able to configure your browser to accept or deny cookies; however, you must enable cookies from unvelope.com in order to use your full membership functions.

5.    Data Analysis
We gather information (statistics) collected on our site from our membership for the following, but not limited to the following. Frequency of the visits, history of the type and category of e-cards sent, trends and statistics, popularity of specific e-cards, areas of website favored and links to other resources. This data helps us determine the popularity/personality of our site. Any information gained in this manner will not be shared with a third party.

6.    Your IP Address
In combination with other information provided by your ISP (Internet Service Provider,) your IP (Internet Protocol) address is used to identify the computer from which a message originates. Unvelope.com will include the sender’s IP address as the source of each of our e-cards members and users send from our website. For security purposes and in accordance with our Terms of Sale and Usage Agreement members/users will not be permitted to send an e-card using signatures such as “from a friend,” “anonymously” and/or “secret admirer,” or like expressions. Your ability and such activity are expressly prohibited.

7.    Privacy of and Disclosure
Unvelope.com Legal Disclosure — Right to disclosure
We treat all of our e-card correspondence as private between the sender and the recipient and we will not disclose the contents of any e-card other than to the intended recipient, except under the specific situations outlined in the Disclosure Exceptions noted in this Policy.

7.1    Disclosure Exceptions
We reserve the right to disclose your personal information if required to do so by law:
1. To comply with a legal process such as a subpoena, search warrant, or court order.
2. To protect and defend the rights and property of unvelope.com and enforce our Terms of Service.
3. To protect unvelope.com against unauthorized use or misuse of our website.
4. To investigate reports that users are sending material using a false e-mail address or users are sending harassing, threatening, or abusive messages.
5. Act in urgent circumstances to protect the personal safety of users of the site or the public, or protect against legal liability.

Please Note: Your IP (Internet Protocol) address can be accessed by e-card recipients in the header of the notification e-mail. Under certain circumstances, e-card recipients, their legal representatives, or law enforcement authorities may be able to combine this with information disclosed by ISPs (Internet Service Providers) to determine the source of a particular communication. By using our service, you knowingly and voluntarily assume any risks associated with such disclosure.

8.   Editing Your Profile
As a member (and after login) you have the ability to edit and review your Personal Account Information at any time. After login, go to your “Account” page. There, you will be directed to an "Update Account Settings" area where you can change your account information (i.e.: your address information, e-mail address, login and credit card information, passwords, etc.)

9.    Security
We strive to takes steps to protect your personal membership information and use encryption and authentication technology. Our servers currently use SSL (Secure Sockets Layer,) an advanced encryption technology to protect the storage and transfer of your data from unauthorized parties. However, no email or internet transmission can be guaranteed to be 100% secure or error free. We cannot absolutely guarantee the security of the information you transmit via our site. For your safety, protection and security we do not store your credit card information. 

10.    Changes to Unvelope.com Privacy Policy
Our site and our business may change from time to time. If there are updates/modifications to our Privacy Policy, unvelope.com reserves the right to update/modify our Privacy Policy at any time and from time to time without prior notice. We encourage you to review this policy regularly. Your continued use of this site after any modifications to our policies shall indicate your agreement with these terms.

11.    Links to Other Sites:
Unvelope.com’s Privacy Policy will apply only to our site. Links to other (third party) websites not controlled or operated by unvelope.com does not imply that unvelope.com endorses or has reviewed the third party site. Our policies and procedures do not apply to third party sites. We do not make any representation as to the quality, fitness or appropriateness, nor do we indemnify you from any losses you may incur as a result of transactions with third party sites. For the privacy policies of third party sites, we suggest you contact those sites directly.

12.    Children
Unvelope.com does not knowingly collect any personal data from children under the age of 16. We ask children under the age of 16 to please not submit any personal information through our site. We believe that children should be able to use the internet in a productive, safe environment. We encourage parents and legal guardians to monitor their children’s internet use.

13.    Sale of Assets
In the event that unvelope.com or subsidiaries are acquired, merged, sold, reorganized, or otherwise transferred, unvelope.com reserves the right to transfer our databases along with any personally identifiable information contained therein to a third party acquiring our assets. If this occurs, we will post the notice of the sale on the homepage of our site along with links to information as to how you can change your privacy preferences.

14.    California Privacy Rights
As of January 1, 2005, California Civil Code Section 1798.83 permits members of our Site who are residents of California to request information regarding disclosure of said member’s personal information to third parties for their direct marketing purposes. 15.    Governing Law
This Agreement, and the respective rights and obligations of the parties hereto, shall be governed by and construed in accordance with the laws of New York, New York, and you and the Company submit to the exclusive jurisdiction of the Federal and State Courts in New York County, New York and the service of process by registered mail or overnight courier with proof of service.
